The ninth circuit court has maintained a ban on deploying state troops in Portland, Oregon, after a latest court ruling.

Appeals Court Concurs to Rehear Case

The ninth circuit court of appeals decided on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an larger group of eleven justices. The court also vacated a previous decision from a smaller judicial group that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the latest turn in a protracted legal battle over whether the former president has the authority and valid reason to send national guard forces in Portland. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while city and state officials assert that local officers have control of the situation.

Contrary to characterizations of Portland as “war ravaged”, locals have been posting footage of lush hiking trails and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in the city issued two legal injunctions this period – one blocking the federalization of the state troops, and another stopping the use of any military personnel in the state, after attempts to circumvent the first order by mobilizing troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting command of state troops – but the second ruling stayed effective, preventing the actual deployment of the troops.

En Banc Review

The latest ruling means the issue will be heard “en banc” – with all decisions under review simultaneously – by a group of 11 judges.

“This ruling demonstrates that the truth matters and that the courts are working to hold this administration accountable. The constitution limits the executive authority, and local populations cannot be treated as a testing site for expansive government power,” stated the legal representative in a official comment.

“The judicial body is sending a clear message: the executive leader cannot dispatch the armed forces into US cities without cause. We will continue defending Oregon’s laws, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
